熟悉英美法理学的，大概都知道本书的价值。本书是斯坦福大学出版的Jurists : profiles in legal theory系列中的一本。不过它不是对哈特理论的简单重述，也包含了作者自己许多独特的理论立场，因而本身也是一本重要的法理学著作。本书的译者是本博友熟悉的刘叶深博士，恭喜叶深。过几天我再请他将后记或相关章节放到本博上来，争取来个“全球网络首发”。

XQ今年开始读博士，不过转了行，去读社会学了。我多少有些遗憾。遗憾的不是她读社会学不好，她的导师非常优秀，她对社会学非常有激情，我相信于她而言，这是一个审慎的、也是不错的选择。可我是学法理学的，我总是希望我欣赏的学生能够留在本专业中。

大学时期是最容易批判却不懂如何批判的。这个断言虽然偏激，我相信错得还不算离谱。如果你正在读大学，对我的断言有同感，或者你刚激情洋溢地发表了一通演讲，却被指出无数论证上的缺点，或者你刚写了一篇批判某书的文章，却被指责根本没看懂这本书，你不妨翻翻这本书。本文讨论的是批判性思维，它涉及到两个方面：

1，我们如何为自己的观点辩护？

2、我们如何客观地评价自己或他人的观点？

本书的重点是第二方面。它的理论简明扼要，提出的指引具体而有针对性，它告诉你一个论证包括那些结构，论题与论证的关系，然后以大量的例子指引你如何去发现他人的观点，如何去检验他人的理由，如何判断他人为理由提供的证据。它也列举了常见的推理错误，它还告诉你如何警惕论者所未明言的价值判断。
